1. Acceptance of Terms

By accessing or using Kashmir Stay ("the Platform", "we", "our", "us"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately stop using the Platform.

These Terms apply to all users, including tourists, businesses, and visitors browsing the Platform.

2. Platform Purpose & Service Description

Kashmir Stay is an online directory and listing platform ONLY. We provide:

• A searchable directory of hotels, resorts, houseboats, travel agencies, and tour operators in Kashmir
• Business contact information (phone, email, website)
• User reviews and ratings
• Business photos and service descriptions

We DO NOT:

• Operate as a travel agency, tour operator, or hotel booking platform
• Handle bookings, reservations, or payments on behalf of tourists or businesses
• Provide travel services, tours, accommodation, or transportation
• Act as an intermediary between tourists and businesses
• Guarantee the accuracy, quality, safety, or legality of services offered by listed businesses

3. User Eligibility

You must be at least 18 years old to use Kashmir Stay. By using this Platform, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into binding agreements
• You will not use the Platform for illegal or unauthorized purposes
• All information you provide is accurate and truthful

Users under 18 may only use Kashmir Stay under the supervision of a parent or legal guardian who agrees to these Terms.

4. User Responsibilities

When using Kashmir Stay, you agree to:

• Conduct Your Own Due Diligence: Research businesses, read reviews, verify credentials, and confirm details before booking any service
• Communicate Directly with Businesses: All inquiries, bookings, payments, and agreements are your responsibility
• Verify Pricing & Availability: Confirm rates, availability, cancellation policies, and terms directly with businesses
• Follow Local Laws: Comply with all applicable laws in Jammu & Kashmir and India
• Travel Safely: Take necessary precautions for your personal safety, health, and security
• Respect Listed Businesses: Do not harass, defame, or engage in fraudulent behavior toward businesses

5. Limitation of Liability – CRITICAL SECTION

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASHMIR STAY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR INTERACTIONS WITH LISTED BUSINESSES.

You acknowledge and agree that Kashmir Stay is merely a facilitator connecting tourists with businesses. We do not endorse, recommend, or guarantee any business listed on the Platform.

6. Business Listings & Verification

Kashmir Stay verifies that businesses are legally registered and hold necessary licenses. However:

• Verification does NOT guarantee service quality, customer satisfaction, or safety
• Businesses may lose licenses, close operations, or change ownership after listing
• Business information (pricing, availability, contact details) may become outdated
• Reviews and ratings are user-generated and may not reflect current conditions

Kashmir Stay is not responsible for verifying real-time accuracy of business information. Users must confirm all details directly with businesses before booking.

7. User Reviews & Content

Users may submit reviews and ratings for businesses. By submitting content, you agree that:

• Your review is based on your personal experience
• You will not post false, defamatory, or malicious content
• Kashmir Stay may edit, remove, or reject reviews that violate our guidelines
• You grant Kashmir Stay a perpetual, non-exclusive license to use, display, and distribute your review

Kashmir Stay reserves the right to remove fake reviews (both positive and negative) and ban users who abuse the review system.

8. Prohibited Uses

You agree NOT to:

• Use the Platform for illegal activities or fraudulent purposes
• Impersonate any person or entity
• Post false or misleading information
• Scrape, copy, or extract data from the Platform without permission
• Interfere with the Platform's operation or security
• Harass, threaten, or defame other users or businesses
• Upload viruses, malware, or harmful code
• Create multiple fake accounts or manipulate reviews

Violation of these prohibitions may result in immediate account termination and legal action.

9. Payment & Transactions

Kashmir Stay does NOT process payments for tourist bookings. All payments for hotels, tours, or services are made directly to the business.

Businesses listed on Kashmir Stay may charge listing fees, premium placement fees, or advertising fees. These are separate B2B transactions and do not involve tourists.

10. Intellectual Property

All content on Kashmir Stay — including text, graphics, logos, design, software — is owned by Kashmir Stay or its licensors and is protected by copyright, trademark, and intellectual property laws.

You may not:

• Reproduce, distribute, or republish Kashmir Stay content without permission
• Use our logo, branding, or trademarks without authorization
• Create derivative works based on our Platform

11. Third-Party Links

Kashmir Stay may contain links to third-party websites (business websites, booking platforms, government portals). We are not responsible for the content, accuracy, or practices of third-party sites. Use them at your own risk.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kashmir Stay, its owners, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your interactions with listed businesses
• Your violation of any third-party rights

13. Disclaimer of Warranties

KASHMIR STAY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The Platform will be error-free, uninterrupted, or secure
• Information on the Platform is accurate, complete, or current
• Listed businesses are trustworthy, safe, or provide quality services
• Your use of the Platform will meet your expectations

14. Modifications to Terms

Kashmir Stay reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

We recommend reviewing these Terms periodically for updates.

15. Termination

Kashmir Stay may suspend or terminate your access to the Platform at any time, with or without cause, for violating these Terms or engaging in prohibited activities.

Upon termination, you must immediately stop using the Platform. Sections of these Terms that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall continue to apply.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India and the State of Jammu & Kashmir. Any disputes arising from your use of Kashmir Stay shall be subject to the exclusive jurisdiction of courts in Srinagar, Jammu & Kashmir.

Before filing any legal claim, you agree to attempt resolution through good-faith negotiation with Kashmir Stay.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Kashmir Stay regarding your use of the Platform.

• You will conduct your own due diligence before booking any service
• You accept all risks associated with travel in Kashmir

If you do not agree to these Terms, you must not use Kashmir Stay.
